European Day Spa of Fredericksburg

These Terms of Service (“Terms”) govern your use of the website at eurospafredericksburg.com (the “Site”), my chat widget, my SMS text messaging program, and the spa services I provide. By accessing the Site, contacting me through the chat widget, opting in to text messages, or booking an appointment with me, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Site or my services.

1. About European Day Spa of Fredericksburg

European Day Spa of Fredericksburg is the trade name (DBA) of Carissa Ballard, a sole proprietor based in Fredericksburg, Texas. Throughout these Terms, “I,” “me,” and “my” refer to Carissa Ballard doing business as European Day Spa of Fredericksburg.

2. Use of the Site

You may use the Site for personal, non-commercial purposes such as learning about my services, contacting me, and booking appointments. You agree not to:

  • Use the Site in any way that violates applicable federal, state, or local laws.
  • Attempt to gain unauthorized access to the Site, my servers, or related systems.
  • Use automated tools (bots, scrapers, etc.) to access or collect information from the Site.
  • Interfere with the proper functioning of the Site.
  • Submit false, misleading, or fraudulent information through any form, the chat widget, or my SMS program.

3. SMS and Text Messaging Program

3.1 Consent and Opt-In

By submitting your phone number through my website chat widget and checking the consent boxes, you expressly authorize European Day Spa of Fredericksburg to send you informational and transactional text messages (SMS/MMS) at the phone number you provide, possibly using automated means. Consent is not a condition of purchase.

3.2 Types of Messages

My SMS program is informational and transactional in nature. Messages may include:

  • Appointment confirmations
  • Appointment reminders
  • Replies to questions you send through the chat widget or by text
  • Service-related updates such as scheduling changes or cancellations

3.3 Message Frequency

Message frequency varies based on your interactions with me and your appointment activity.

3.4 Message and Data Rates

Message and data rates may apply, depending on your mobile carrier and plan. I am not responsible for charges from your wireless carrier.

3.5 How to Opt Out

You can opt out of my SMS program at any time by replying STOP to any text message you receive from me. After replying STOP, you will receive a final confirmation message and will no longer receive text messages from me. You may also email eurospatx@gmail.com to request opt-out.

3.7 Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Supported carriers include AT&T, Verizon Wireless, T-Mobile, Sprint, U.S. Cellular, and most other major carriers in the United States.

4. Appointments and Services

4.1 Booking

Services are provided by appointment only. Group appointments require advance notice. Appointments may be requested by phone at 830-997-5267, by email, in person, or through the chat widget. All appointments are subject to availability and confirmation.

4.2 Credit Card to Hold Reservations

A credit card is required to hold reservations.

4.3 Cancellation and No-Show Policy

I require 24 hours’ notice for cancellations. Out of respect for my time and other clients who may have wanted the appointment, a charge equal to 50% of the scheduled service will be applied if you do not show up for your appointment or if you cancel within 24 hours of the appointment time.

4.4 Arrival

Please arrive a few minutes before your scheduled appointment. Late arrivals may result in a shortened service so that other guests are not delayed.

4.5 Health and Safety

Please inform me of any medical conditions, allergies, injuries, or pregnancy at the time of booking and again upon arrival. Some services may not be appropriate for certain conditions. I reserve the right to decline or modify a service when, in my judgment, it is not safe or advisable to proceed.

4.6 Service Outcomes

Spa services are provided for relaxation and wellness purposes. Individual results vary, and no specific outcome is guaranteed. Spa services are not a substitute for medical care, diagnosis, or treatment.

5. Payment

Payment for services is collected at the spa at the time of service unless otherwise arranged. I accept commonly used forms of payment as posted at my location. Gratuities are appreciated but not required.

6. Gift Certificates

Gift certificates may be purchased in person or by phone. Gift certificates are transferable but are not redeemable for cash, and cash refunds are not provided to recipients of gift certificates, except where required by law. Lost or stolen gift certificates cannot be replaced. Gift certificates must be presented at the time of service.

7. Intellectual Property

All content on the Site, including text, images, logos, graphics, and design elements, is owned by Carissa Ballard doing business as European Day Spa of Fredericksburg, or by my licensors, and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any content on the Site without my prior written permission, except for personal, non-commercial viewing.

8. Third-Party Links and Services

The Site and chat widget may contain links to or rely on third-party services (for example, the chat widget is powered by LeadConnector). I am not responsible for the content, privacy practices, or availability of third-party websites or services. Your use of those services is governed by their own terms and privacy policies.

9. Privacy

Your use of the Site and SMS program is also governed by my Privacy Policy, available at https://www.eurospafredericksburg.com/privacy-policy/. Please review the Privacy Policy to understand how I collect, use, and protect your information.

10. Disclaimers and Limitation of Liability

THE SITE AND ALL CONTENT, SERVICES, AND INFORMATION PROVIDED THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CARISSA BALLARD DOING BUSINESS AS EUROPEAN DAY SPA OF FREDERICKSBURG WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR MY SERVICES, EVEN IF I HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

11. Indemnification

You agree to indemnify and hold harmless Carissa Ballard doing business as European Day Spa of Fredericksburg from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

12. Changes to These Terms

I may update these Terms from time to time. When I do, I will revise the “Effective Date” at the top of this page. Your continued use of the Site or my services after I post changes means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or your use of the Site will be brought in the state or federal courts located in Gillespie County, Texas, and you consent to the personal jurisdiction of those courts.
